Terms of Use

Terms governing access to and use of the GemSource Recruitment website.

Effective date: 1 May 2026

1. About these Terms

These Terms of Use govern access to and use of the GemSource Recruitment website, including its pages, content, contact forms, candidate enquiry or registration forms, insights, and linked resources.

This website is an informational and conversion-focused business website. It is not a public job board, open candidate marketplace, self-service recruitment platform, or candidate-facing portal.

By accessing or using this website, a user agrees to these Terms of Use. If a user does not agree, they should stop using the website.

These Terms of Use apply only to website use. They do not replace any separate client agreement, recruitment services agreement, terms of business, contractor agreement, confidentiality agreement, or other written contract issued by GemSource Recruitment.

2. Business model disclosure

GemSource Recruitment operates a client-only, agency-led recruitment model.

GemSource Recruitment primarily delivers services through retained or contingent search, proactive headhunting, referrals, targeted approach, and managed recruitment processes.

The website does not allow users to create public candidate accounts, browse an open list of vacancies, communicate with other users, or participate in an open-access employment marketplace.

Where appropriate, GemSource Recruitment may advertise or reference roles using selected third-party platforms, including public job boards. In those cases, candidates may be directed to apply through the relevant external platform or directly to GemSource Recruitment, depending on the mandate.

Any job information, article, link, or opportunity displayed on this website is provided for general informational purposes unless expressly stated otherwise.

3. Eligibility and permitted use

A user may access this website only for lawful purposes connected with learning about GemSource Recruitment, making a business enquiry, submitting a targeted candidate enquiry, or otherwise engaging with GemSource Recruitment in a legitimate professional capacity.

A user must not:

  • use the website in a way that is unlawful, misleading, fraudulent, defamatory, abusive, harassing, or discriminatory
  • upload, submit, or transmit false, inaccurate, or misleading information
  • interfere with the website, its security, hosting environment, forms, or functionality
  • introduce malware, viruses, scripts, bots, scraping tools, or other harmful code
  • copy, republish, frame, scrape, data-mine, mirror, or commercially exploit website content without prior written consent
  • use the website to send unsolicited communications, spam, or other material that may contravene the Spam Act 2003 (Cth)
  • impersonate another person or misrepresent authority, qualifications, employment history, business relationship, or identity

GemSource Recruitment may suspend, restrict, or block access where misuse is suspected.

4. No public employment marketplace

This website is not intended to operate as an electronic employment exchange, digital labour marketplace, or online application portal for general public use.

Any candidate details submitted through this website are reviewed internally by GemSource Recruitment and handled through an agency-led process.

Submission of an enquiry, resume, or registration form does not create a right to representation, placement, interview, shortlist, employment, contractor engagement, or ongoing consideration for roles.

GemSource Recruitment may decide, in its discretion and subject to law, whether a candidate profile is suitable for current or future opportunities.

5. Accuracy of information

GemSource Recruitment seeks to ensure website content is current, accurate, and useful. However, the website and its content are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, GemSource Recruitment does not guarantee that:

  • website content is complete, accurate, current, or free from error
  • any role, insight, salary guidance, hiring trend, or market commentary remains available or up to date
  • the website will be uninterrupted, secure, or free from defects, malware, or third-party interference

Information on this website is general in nature and does not constitute legal advice, workplace relations advice, migration advice, tax advice, financial advice, or any guarantee of recruitment outcomes.

6. Candidate and client submissions

If a user submits information through this website, the user warrants that the information submitted is accurate, up to date, and submitted with lawful authority.

If personal information is submitted on behalf of another person, the person submitting it warrants that they have authority to do so and that the relevant individual has been informed as required.

A user must not submit confidential, sensitive, proprietary, or third-party information unless reasonably necessary and lawfully permitted.

GemSource Recruitment may remove, disregard, or destroy submissions that are incomplete, inappropriate, unlawful, irrelevant, or inconsistent with its business model or legal obligations.

7. Privacy, consent, and collection notice

GemSource Recruitment may collect personal information through contact forms, candidate enquiries, referral communications, direct sourcing activity, email correspondence, telephone discussions, and other recruitment-related interactions.

Personal information may include a person's name, contact details, resume information, employment history, qualifications, referee details, compensation information, right-to-work information, and other information reasonably necessary for recruitment or business development purposes.

GemSource Recruitment handles personal information in accordance with its Privacy Policy and applicable privacy law obligations.

Where candidate information is collected for recruitment purposes, GemSource Recruitment may use that information to:

  • assess suitability for current or future opportunities
  • contact the individual about recruitment processes or related business matters
  • verify experience, qualifications, work rights, references, or other relevant details
  • maintain internal recruitment, compliance, and relationship management records
  • share a candidate profile with a client only with the candidate's consent or where otherwise permitted by law

Where sensitive information is involved, GemSource Recruitment will seek consent where required by law and will only collect what is reasonably necessary for its functions.

A person may choose not to provide requested information, but this may limit GemSource Recruitment's ability to respond to an enquiry, assess suitability, progress a recruitment process, or provide services.

A user should refer to the GemSource Recruitment Privacy Policy for further detail about collection, use, disclosure, storage, access, correction, complaints, and overseas disclosures (if any).

8. External platforms and third-party links

This website may contain links to third-party websites, including job boards, social media platforms, publications, client systems, or other external services.

GemSource Recruitment does not control and is not responsible for third-party websites, content, availability, privacy practices, security, or terms.

Accessing a third-party site is at the user's own risk. Users should review the third party's own terms, privacy policy, and security settings.

9. Intellectual property

Unless otherwise stated, all website content on this website, including text, branding, trade marks, logos, graphics, layouts, insights, articles, downloads, and material prepared by GemSource Recruitment, is owned by or licensed to GemSource Recruitment and protected by applicable intellectual property laws.

A user is granted a limited, revocable, non-exclusive, non-transferable licence to access and view website content for personal or internal business reference only.

A user must not, without prior written permission:

  • reproduce, adapt, distribute, publish, sell, licence, or exploit website content
  • use GemSource Recruitment branding, trade marks, or content in a way that implies endorsement or association
  • scrape or harvest content, contact data, or profiles for competing commercial use
  • Nothing in these Terms transfers any intellectual property rights to a user.

10. Electronic communications

A user agrees that GemSource Recruitment may communicate electronically in relation to website enquiries, recruitment engagement, consent requests, administration, and service communications.

Where GemSource Recruitment sends commercial electronic messages, it intends to do so in accordance with the Spam Act 2003 (Cth), including identifying the sender and providing an unsubscribe facility where required.

11. Limitation of liability

To the maximum extent permitted by law, GemSource Recruitment excludes all liability for any loss, damage, cost, or expense arising from or connected with use of, or inability to use, the website or reliance on website content.

This includes indirect, incidental, special, exemplary, or consequential loss; loss of profits; loss of opportunity; business interruption; loss of data; or reputational harm.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or other right that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

12. Indemnity

A user indemnifies GemSource Recruitment, its officers, employees, contractors, and agents against claims, losses, liabilities, damages, and expenses arising from the user's breach of these Terms, misuse of the website, infringement of another person's rights, or unlawful conduct.

This clause applies to the extent permitted by law.

  • update, modify, suspend, or discontinue any part of the website
  • change website content, forms, services, or functionality
  • amend these Terms of Use by publishing an updated version on the website

The updated Terms take effect from the published effective date. Continued use of the website after updated Terms are published constitutes acceptance of the revised Terms.

14. Security

GemSource Recruitment takes reasonable steps to protect information submitted through the website. However, no internet transmission or storage system is completely secure.

A user is responsible for taking their own precautions to ensure that any method used to access the website is free from viruses, malicious code, or other harmful components.

15. Jurisdiction and governing law

These Terms of Use are governed by the laws of Queensland, Australia, and the Commonwealth of Australia where applicable.

A user submits to the non-exclusive jurisdiction of the courts of Queensland and courts competent to hear appeals from those courts.
